A. Definitions
- "Account": Your legal relationship with EmbedCrest.
- "Service": The website, testing tools, deployment pipelines, and APIs provided by EmbedCrest.
- "Content": Code, test scripts, logs, data, and text uploaded to the Service.
- "Machine Account": An account used exclusively for automated tasks (CI/CD), managed by a human.
B. Account Terms
- Human Requirement: You must be a human. Accounts registered by "bots" are prohibited, though "Machine Accounts" are allowed for automation.
- Age: You must be 13 or older.
- Security: You are responsible for maintaining the security of your password and account. EmbedCrest cannot be liable for loss resulting from your failure to secure your credentials.
C. Acceptable Use
You may not use EmbedCrest to:
- Violate any laws (copyright, privacy, or export control).
- Interfere with the Service's integrity (e.g., attempting to "stress test" our own infrastructure without written permission).
- Scrape data for the purpose of training commercial AI without an Enterprise agreement.
D. User-Generated Content
- Ownership: You retain ownership of code and scripts you upload.
- License to Us: To provide the Service, you grant EmbedCrest a worldwide, royalty-free license to store, parse, and display your Content (e.g., to run your tests and show you the results).
- Public Content: Content marked "Public" may be viewed and forked by other Users.
E. Private Repositories & Workspaces
We treat your private code and test data as Confidential Information. We will only access it to:
- Resolve support requests initiated by you.
- Maintain system security or integrity.
- Comply with legal obligations.
F. API & Automated Testing Terms
- Rate Limits: Abuse or excessively frequent API requests may lead to temporary suspension.
- Testing Conduct: You may not use EmbedCrest to launch Denial of Service (DoS) attacks or scan third-party websites for vulnerabilities without authorization.
G. Payment and Cancellation
- Billing: Paid plans are billed in advance and are non-refundable.
- Downgrades: Downgrading may result in the loss of Content, features, or capacity.
- Cancellation: You may cancel at any time through your Account Settings. Upon cancellation, we delete your profile and private data within 30 days.
H. Disclaimer of Warranties
The Service is provided "as is." EmbedCrest and its suppliers hereby disclaim all warranties of any kind, express or implied, including that the Service will be error-free or that access will be continuous or uninterrupted.
I. Limitation of Liability
In no event will EmbedCrest be liable for any damages, loss of data, or cost of procurement of substitute services exceeding the fees paid by you to EmbedCrest during the 12 months prior to the cause of action.
